Duncan Distribution Co., LLC dba Hummingbird Networks (also referred to in this policy as we, us, or our) operates the website located at https://www.hummingbirdnetworks.com and the related online services (collectively, the Site). We sell information technology products, equipment, peripherals, and offer related IT services to consumers and businesses.

This Privacy Policy describes how we collect, use, disclose, and retain personal information about visitors to and customers of our Site, the choices you have about your information, and the rights available to you under California and federal law. It applies to personal information we collect through the Site, when you make a purchase, when you contact us, and when you interact with our marketing communications.

Our Site is intended for users located in the United States. If you access the Site from outside the United States, please be aware that your information will be transferred to, stored, and processed in the United States, where data-protection laws may differ from those in your location.

Sensitive personal information. We do not intentionally collect sensitive personal information as defined by the CCPA (such as government identifiers, precise geolocation, account log-in credentials combined with access codes, racial or ethnic origin, or the contents of your communications) for the purpose of inferring characteristics about you. If you create an account, we collect log-in credentials, which we use only to provide and secure your account. We do not use or disclose sensitive personal information for purposes that would give rise to the right to limit its use described in Section 7.

We do not collect payment card numbers ourselves. When you make a purchase, your payment card details are provided directly to our third-party payment processors, as described in Section 9.

Sources of personal information

We collect personal information from the following categories of sources:

  • Directly from you — when you place an order, create an account, contact customer support, sign up for our newsletter or text messages, or otherwise interact with us.
  • Automatically from your device — through cookies and similar technologies when you use the Site (see Section 4).
  • From service providers and third parties — including payment processors, analytics providers, and advertising partners that help us operate the Site and understand how it is used.

2. How We Use Your Personal Information

3. Retention of Personal Information

We retain each category of personal information for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law. To determine the appropriate retention period, we consider:

  • The length of time we have an ongoing relationship with you and provide the Site to you (for example, for as long as you maintain an account or continue to purchase from us);
  • Whether there is a legal, tax, accounting, or regulatory obligation that requires us to retain the information;
  • Whether retention is advisable to resolve disputes, enforce our agreements, or protect against legal claims; and
  • The nature and sensitivity of the information and the potential risk of harm from unauthorized use or disclosure.

As a general matter, we retain customer account and transaction records for the duration of your relationship with us and for a reasonable period afterward to meet the purposes above. Usage data collected through cookies and similar technologies is generally retained for a shorter period, except where it is used to strengthen security, improve the Site, or where we are legally obligated to retain it longer. When personal information is no longer needed, we take steps to securely delete, de-identify, or anonymize it.

4. Cookies and Tracking Technologies

We and our service providers and advertising partners use cookies, web beacons, pixels, tags, scripts, and similar tracking technologies to operate the Site, remember your preferences, analyze traffic and usage, and support advertising.

How we respond to Do Not Track and opt-out preference signals. Some browsers offer a Do Not Track (DNT) setting. There is no common industry standard for how to respond to DNT signals. As described in Section 6, we honor recognized opt-out preference signals, such as the Global Privacy Control (GPC), as valid requests to opt out of the sale and sharing of personal information for the browser or device from which the signal is sent.

5. How We Disclose Personal Information

We disclose personal information to the following categories of recipients for the business and commercial purposes described in this Privacy Policy:

  • Service providers and contractors who process personal information on our behalf and are contractually restricted from using it for any purpose other than performing services for us. These include payment processors, order-fulfillment and installation subcontractors, shipping providers, database and hosting providers, backup and disaster-recovery providers, email and marketing-communications providers, customer-support providers, and analytics providers.
  • Advertising partners, in connection with cross-context behavioral advertising, as described in Sections 4 and 6.
  • Professional advisors, such as auditors, lawyers, and accountants, where necessary.
  • Government authorities and other parties, when we believe in good faith that disclosure is necessary to comply with a legal obligation or valid legal process (such as a court order, subpoena, or government request); to protect and defend our rights or property; to prevent or investigate possible wrongdoing in connection with the Site; to protect the personal safety of users of the Site or the public; or to protect against legal liability.
  • Successors in a business transaction — if we are involved in a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar transaction, personal information may be transferred as part of that transaction. Any successor will be required to honor this Privacy Policy or provide notice of any material change.

We do not disclose personal information to third parties for their own independent marketing purposes without your consent.

6. Sale and Sharing of Personal Information; Cross-Context Behavioral Advertising

The CCPA defines selling and sharing broadly. Sharing includes disclosing personal information to a third party for cross-context behavioral advertising, even when no money is exchanged.

We do not sell your personal information for money. However, our use of third-party advertising cookies and technologies (see Section 4) may be considered sharing of your personal information (specifically, identifiers and internet or other electronic network activity information) for cross-context behavioral advertising under the CCPA. We share this information with our advertising partners for the purpose of delivering advertising that is relevant to you across other websites and services.

We do not have actual knowledge that we sell or share the personal information of consumers under 16 years of age.

Your right to opt out. You have the right to opt out of the sale or sharing of your personal information at any time. You may exercise this right by:

  • Using the “Do Not Sell or Share My Personal Information” link found at the bottom of this policy; and
  • Enabling a recognized opt-out preference signal, such as the Global Privacy Control (GPC). When you visit our Site using a browser or device that transmits the GPC signal, we treat it as a valid request to opt out of the sale and sharing of personal information for that browser or device and, where we can identify you, for your consumer account. Because an opt-out preference signal is tied to a specific browser or device, you will need to enable it on each browser and device you use.

Opting out will not allow us to associate the opt-out with you across all browsers and devices unless you are logged in to your account.

7. Your California Privacy Rights

If you are a California resident, the CCPA (as amended by the California Privacy Rights Act) grants you the following rights regarding your personal information:

  • Right to know / access. You may request that we disclose the categories and specific pieces of personal information we have collected about you; the categories of sources; the business or commercial purposes for collecting, selling, or sharing it; and the categories of third parties to whom we disclose it.
  • Right to delete. You may request that we delete personal information we have collected from you, subject to certain exceptions (for example, where we need the information to complete a transaction, comply with a legal obligation, detect security incidents, or for other permitted purposes).
  • Right to correct. You may request that we correct inaccurate personal information we maintain about you.
  • Right to opt out of sale/sharing. You may opt out of the sale or sharing of your personal information, as described in Section 6.
  • Right to limit the use of sensitive personal information. As described in Section 1, we do not use or disclose sensitive personal information for purposes that trigger this right. If our practices change, we will provide the required notice and a means to exercise this right.
  • Right to data portability. When you request access to your information, you may request it in a portable and, to the extent technically feasible, readily usable format.
  • Right to non-discrimination. We will not discriminate or retaliate against you for exercising any of your privacy rights. We will not deny you goods or services, charge you a different price, or provide you a different level or quality of service because you exercised your rights.

8. How to Exercise Your Rights

Submitting a request. Because we interact with our customers primarily online, you may submit a request to know, delete, or correct your personal information by:

To opt out of the sale or sharing of your personal information, use the Do Not Sell or Share My Personal Information link or an opt-out preference signal, as described in Section 6 (no account or verification is required to opt out).

Verification. For requests to know, delete, or correct, we must verify your identity before responding. We will ask you to provide information that we can reasonably match against the information we maintain about you (for example, your name, email address, and details relating to your account or a recent order). We may request additional information if necessary to verify your identity to the appropriate degree of certainty, given the sensitivity of the personal information at issue. We will not require you to create an account to make a request, but if you already have an account, we may ask you to use it to submit or verify a request. Any additional information you provide for verification will be used only for that purpose.

Authorized agents. You may use an authorized agent to submit a request on your behalf. We may require the agent to provide proof that you gave them signed permission to act for you, and we may require you to verify your own identity directly with us or to confirm that you provided the agent permission.

Response timing. We will confirm receipt of your request within 10 business days and will respond to a verifiable request within 45 days. If we need more time, we may extend the period by an additional 45 days and will notify you of the extension and the reason within the initial 45-day period. Requests to know will generally cover the 12-month period preceding your request. There is no charge to submit a request unless it is excessive, repetitive, or manifestly unfounded.

We use third-party payment processors to handle payments made through the Site. We do not store or collect your payment card details; that information is provided directly to our payment processors, whose use of your information is governed by their own privacy policies. Our payment processors adhere to the standards set by the PCI Security Standards Council (PCI-DSS), which help ensure the secure handling of payment information.

10. Marketing Communications and Your Choices

Email. We may send you newsletters and marketing emails about products, services, and offers. Every marketing email we send identifies us as the sender, includes our valid physical postal address, and contains a clear unsubscribe mechanism. You may opt out of marketing emails at any time by using the unsubscribe link in any such email or by contacting us. We will honor opt-out requests promptly. Opting out of marketing emails will not affect transactional or service messages relating to your orders or account.

Text messages (SMS). If you provide your mobile number and opt in to receive text messages, you consent to receive recurring automated marketing text messages from Hummingbird Networks at that number. Consent is not a condition of any purchase. Message and data rates may apply, and message frequency varies. You may opt out at any time by replying STOP to any message or by contacting us; you may reply HELP for help. We obtain your prior express written consent before sending marketing text messages, consistent with applicable law.

11. Data Security

We use commercially reasonable administrative, technical, and physical safeguards designed to protect the personal information we maintain. However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. You provide information to us at your own risk. Where a password is used to access areas of the Site, you are responsible for keeping your password confidential.

12. Children’s Privacy

Our Site is intended for a general audience and is not directed to children. We do not knowingly collect personal information from children under 13 years of age, and we do not knowingly sell or share the personal information of consumers under 16. California’s “Shine the Light” law (Cal. Civ. Code § 1798.83) permits California residents to request certain information about a business’s disclosure of personal information to third parties for those third parties’ own direct-marketing purposes. We do not disclose personal information to third parties for their own direct-marketing purposes. 15. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we make changes, we will revise the “Last Updated” date at the top of this policy and post the updated policy on this page. If we make material changes, we will provide additional notice as appropriate, such as by email or a prominent notice on the Site before the change takes effect. We encourage you to review this Privacy Policy periodically. Your continued use of the Site after an update becomes effective indicates your awareness of the revised policy.
